The small parts rule - 3+ toys versus under-3 toys

US rules treat small parts differently by age. A toy for under-3 children must not contain a part that fits the small-parts cylinder; a toy for 3-6 children may contain such a part, but it must carry the choking-hazard warning and the part must not detach under the abuse tests.

What the rule is for

16 CFR 1501 bans small parts in toys intended for children under 3, because young children mouth and swallow parts. For toys intended for children 3-6, a small part is allowed but the toy needs the required warning label.

That is the practical boundary for a classroom range: 3+ toys may have small parts, but the label has to say so, and the part has to stay attached when the toy is dropped, pulled and twisted.

Designing for 3+ classrooms

  • Fix knobs, wheels, caps and buttons with screws or dowels, not push-fits.
  • Avoid parts that can be bitten, pried or twisted off by a determined child.
  • Label small-parts sets with the warning even when the set also works for older children.
  • Keep the smallest part above the cylinder when the room mixes 3 year olds with older children.
  • Test the model, not only the prototype.

Warning wording

  • Choking-hazard warning: "WARNING: CHOKING HAZARD - Small parts. Not for children under 3 yrs."
  • The exact wording and language follow the destination market and the importer's label.
  • The warning must stay legible after cleaning; printed and engraved labels are checked.
  • We provide the label artwork; the importer approves the final content.

Questions buyers ask

Are small parts allowed on 3+ toys?
Yes, with the required choking-hazard warning for toys intended for children 3-6. The part must still stay attached under the abuse tests.
Does a 3+ set need the warning if it is used by 5 year olds?
If the set is intended for children 3-6 and contains a small part, it carries the warning. The age grade and label are set per model.
Who decides the age grade?
The manufacturer or importer sets the grade using the toy's design, parts and play pattern, and the destination market's rules. We provide the design data and the grading rationale on request.
